Regium Concierge Terms of Service

1. Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the website located at regiumconcierge.com, any successor domain operated by Regium Concierge, and all related booking forms, communications, and services (collectively, the “Site” and the “Services”). Regium Concierge is operated by Regium Concierge, LLC, a California limited liability company (“Regium,” “we,” “us,” or “our”). By accessing the Site, submitting an inquiry, or engaging Regium for any Service, you (“you” or “Client”) agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.
2. Global Scope of Services
Regium is a global lifestyle management and concierge company serving Clients located throughout the world. The Services may be requested from, and performed in, multiple countries, and Third Party Providers may be located outside the United States. Regardless of where you access the Site or where a Service is ultimately performed, your relationship is with Regium Concierge, LLC, and these Terms, including the governing law and dispute resolution provisions in Section 16, apply uniformly to all Clients worldwide.
You are responsible for ensuring that your request, travel, and use of any Third Party Provider comply with the laws of every jurisdiction involved, including entry and exit requirements, customs regulations, permits, and local licensing rules. Regium will assist with logistics where reasonably possible but is not responsible for a Client's failure to comply with local law, immigration requirements, or documentation requirements in any jurisdiction.
3. Description of Services
Regium provides global lifestyle management and concierge services, including but not limited to bespoke travel planning, private aviation arrangement, yacht and villa procurement, event and reservation access, and related luxury lifestyle coordination (the “Services”). The scope of any specific engagement is defined by the individual arrangement made between Regium and the Client, whether by phone, email, or written confirmation.
4. Concierge and Referral Relationship; Third Party Providers
Regium acts as an intermediary and arranger. We identify, negotiate with, and coordinate access to independent third party providers, including but not limited to aircraft charter operators, yacht charter companies, villa owners and property managers, hospitality venues, and event organizers (collectively, “Third Party Providers”), wherever located. Regium does not own, operate, staff, insure, or control any aircraft, vessel, vehicle, property, or venue used to fulfill a Client request.
Regium is not a common carrier, travel agent of record, air carrier, charter operator, or property manager, and nothing in these Terms should be construed as making Regium a party to the underlying contract for carriage, charter, lease, or service between the Client and any Third Party Provider unless expressly stated in writing. All such arrangements are subject to the separate terms, conditions, licenses, insurance coverage, and cancellation policies of the applicable Third Party Provider, and to the laws of the country in which that Third Party Provider operates, which the Client is responsible for reviewing and accepting.
Regium exercises reasonable care in the selection of Third Party Providers but does not guarantee the availability, conduct, safety record, solvency, or performance of any Third Party Provider, and is not liable for any act, omission, delay, cancellation, injury, loss, or damage caused by a Third Party Provider.
5. Eligibility and Inquiries
The Services are intended for individuals who are at least eighteen years of age and who have the legal capacity to enter into binding agreements. By submitting an inquiry through the Site, you represent that the information provided is accurate and that you are authorized to submit the request, including on behalf of any additional guests or travelers named in connection with the request.
6. Sanctions, Export Control, and Prohibited Persons
As a global company, Regium is committed to complying with applicable trade sanctions, export control, and anti money laundering laws, including those administered by the U.S. Department of the Treasury's Office of Foreign Assets Control and equivalent authorities in other jurisdictions in which we operate. By submitting an inquiry, you represent that you are not, and are not acting on behalf of, any individual or entity that is the subject of applicable sanctions, is located in a comprehensively sanctioned jurisdiction, or is otherwise prohibited from receiving services under applicable law.
Regium reserves the right to decline, suspend, or terminate any Service, without liability, where Regium reasonably believes providing the Service would violate applicable sanctions, export control, or anti money laundering laws.
7. Fees, Deposits, and Payment
Fees for Services, including any Regium service fee and all Third Party Provider charges, will be quoted and confirmed in writing prior to booking, typically in United States dollars unless otherwise agreed. Where fees are quoted or charged in a currency other than the currency of your payment method, you are responsible for any currency conversion cost and exchange rate fluctuation. Deposits may be required to secure aircraft, vessels, properties, or reservations, and are generally non refundable once a Third Party Provider has been engaged, except as otherwise stated in the applicable booking confirmation. Full payment terms will be set out in each individual booking confirmation and, where a deposit or payment is processed, are incorporated into these Terms by reference.
8. Cancellations and Changes
Cancellation and change policies vary by Service and by Third Party Provider, and will be disclosed at the time of booking. Regium is not responsible for cancellation fees, penalties, or forfeited deposits imposed by a Third Party Provider. Requests to cancel or modify a confirmed booking must be submitted in writing to bookings@regiumconcierge.com.
9. Client Conduct
You agree not to use the Site or the Services for any unlawful purpose, to submit false or misleading information, to interfere with the operation of the Site, or to use the Services in a manner that exposes Regium or any Third Party Provider to legal liability.
10. Intellectual Property
The Site, including its text, graphics, logos, and the marks “Regium Concierge” and “Limitless Living,” is owned by or licensed to Regium Concierge, LLC and is protected by applicable intellectual property laws worldwide. No license to use any Regium trademark, trade name, or content is granted except as necessary to view the Site for personal, non commercial purposes. Unauthorized use, reproduction, or distribution of Site content is prohibited.
11. Confidentiality
Regium treats Client information, itineraries, and preferences as confidential and will not disclose such information except as necessary to fulfill a request, as required by law, or as otherwise permitted under our Privacy Policy. Client agrees to keep confidential any non public rate, negotiation, or business information shared by Regium in connection with a booking.
12. Disclaimers
THE SITE AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, REGIUM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. REGIUM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REGIUM, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE SERVICES, INCLUDING ANY ACT OR OMISSION OF A THIRD PARTY PROVIDER. REGIUM'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY CLIENT TO REGIUM, EXCLUSIVE OF THIRD PARTY PROVIDER CHARGES PASSED THROUGH TO CLIENT, FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Regium and its officers, members, employees, and affiliates from any claim, liability, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
15. Communications Consent
By submitting an inquiry and providing your phone number and email address, you consent to receive calls, text messages, and emails from Regium regarding your inquiry and any active or prospective booking, including through automated or prerecorded means where applicable and permitted by local law. Consent to receive text messages is not a condition of any purchase. You may opt out of marketing communications at any time by following the unsubscribe instructions provided or by contacting bookings@regiumconcierge.com. Message and data rates may apply.
16. Governing Law, Arbitration, and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, regardless of your country of residence or the country in which a Service is performed. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered in Los Angeles County, California, on an individual basis. YOU AND REGIUM EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Any claim not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
Opt Out Right. You may opt out of this arbitration provision by sending written notice to bookings@regiumconcierge.com within thirty days of the date you first agree to these Terms. Your notice must include your name, the email address or phone number associated with your inquiry, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will proceed exclusively in the state or federal courts located in Los Angeles County, California, as described above, and all other provisions of these Terms remain in effect.
If you reside in a jurisdiction that grants you non waivable local consumer protections or a mandatory local forum for certain categories of claims, this Section 16 applies to the fullest extent permitted by the law of that jurisdiction, and nothing in this Section 16 is intended to override a protection that cannot lawfully be waived.
17. Force Majeure
Regium is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, weather, government action, labor disputes, mechanical failure, pandemic, terrorism, or other events of force majeure, whether affecting Regium or any Third Party Provider, in any country.
18. Changes to These Terms
Regium may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the Site or the Services after changes are posted constitutes acceptance of the revised Terms.
19. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any written booking confirmation, constitute the entire agreement between you and Regium regarding the subject matter herein and supersede any prior agreements.
